Mechanical smoke control systems use powered fans and smoke exhaust shafts to force smoke and heat up and out of the building, replacing it with fresher and cooler air from outside. Don’t be fined: Clause 177 of the NSW Environmental Planning and Assessment Regulation 2000 states that it is an offence to fail to provide the statement. Escalating cumulative weekly penalty notices apply for this offence, for example, $1000 per week.
Don’t risk legal action: Not submitting an Annual Fire Safety Statement could lead to civil or criminal proceedings in the Land and Environment Court. The maximum penalty for a breach is $110,000.
