What are Annual Fire Safety Statements?

 

Commonly shortened to AFSS, Annual Fire Safety Statements are a certification that is a statutory requirement of your council, NSW Fire & Rescue and your insurance provider.


Under the provisions of the NSW Environmental Planning and Assessment Regulation 2000 (EP & A Reg), owners of buildings have a legal obligation to supply the Commissioner of the NSW Fire Brigades with a copy of their Fire Safety Certificate or Annual Fire Safety Statement, listing the fire safety measures applicable to their building.


This certification can only be provided by an accredited fire inspector, like Chief AFSS Services. The Annual Fire Safety Statements then legally confirms that the facility management team of any commercial building have undertaken all required fire safety measures and that the premises meet or exceed fire safety requirements to Australian standards.


The Annual Fire Safety Statement must state that a competent fire safety practitioner has inspected and assessed the fire safety measures in the building, and found that the measures are capable of performing to the Australian standard. Once submitted a copy of the statement or certificate must then be prominently displayed in the building.


A Fire Safety Certificate is a certificate that is submitted by the building owner, certifying all essential fire safety measures (listed in the Fire Safety Schedule) have been installed in the building, and are capable of performing to the standard listed in the Fire Safety Schedule.


A Fire Safety Schedule can be issued with a Construction Certificate. The Fire Safety Schedule lists the essential fire safety measures that are to be installed in the building or on the site and the Australian and/or other Standards to which they must be installed.

Under the current protocol, building owners are responsible for submitting and signing the Fire Safety Certificate and the AFSS.

No matter what your lease agreements says, fire compliance is ultimately the responsibility of the landlord. As a landlord (or their representative), when you sign a Fire Safety Certificate or AFSS you are personally declaring that the premises meets the Australian Standard for fire safety and has been maintained and “assessed by competent fire safety practitioner”. This personal liability is why all landlords should partner with an expert in this area, ensuring their tenants are safe and they are personally protected.

 With ever changing guidelines and harsh penalties for breaches, not working with an accredited professional carries high risk personal, financial and legal risk.

Don’t be fined: Clause 177 of the NSW Environmental Planning and Assessment Regulation 2000 states that it is an offence to fail to provide the statement. Escalating cumulative weekly penalty notices apply for this offence, for example, $1000 per week.

Don’t risk legal action: Not submitting an Annual Fire Safety Statement could lead to civil or criminal proceedings in the Land and Environment Court. The maximum penalty for a breach is $110,000.

Don’t risk your insurance: Failing to have your fire equipment properly inspected, and not lodging an Annual Fire Safety Statement, can be grounds for the voiding of your fire insurance.

Don’t negate life saving responsibilities: Most importantly, a failure to meet these important legal requirements can put people’s lives at risk, as well as having enormous implications for the building owner.
